Licensing of Contractors Ordinance

WHEREAS, the Board of Supervisors of Rankin County, Mississippi desires to implement a procedure for the licensing of mechanical, electrical, and plumbing contractors and sub-contractors and to require a bond in order to qualify to do business within the County unless a certificate of responsibility is held from the State of Mississippi; and,

WHEREAS, said procedure is necessary to protect the public health, safety, and welfare of the residents of Rankin County, Mississippi.

NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Rankin County, Mississippi as follows:

Section 1: All commercial and residential construction general contractors and mechanical, electrical · and plumbing general contractors before doing business within Rankin County, Mississippi, shall first register with the county Building Official in order to qualify to do business within the County. It is hereby established that the Building Official shall maintain a list of general contractors and sub-contractors who have duly registered.

Section 2: In order to register, a commercial and residential construction general contractor or subcontractor shall comply with Mississippi Code of 1972, Annotated, Section 27- 17-457(1) or shall hold a certificate of responsibility from the State of Mississippi or 27-17- 451(2), shall hold a master level license and shall post a $5,000.00 performance bond with the Building Official, said bond being payable to Rankin County and being conditioned on said contractor complying with all ordinances and regulations of Rankin County, Mississippi.

Section 3: Before a commercial and residential construction general contractors or subcontractor can be added to the registered list, each such contractor or subcontractor shall provide the Building Official with satisfactory proof that said contractor or subcontractor has in force general liability insurance in an amount of not less than $300,000 per occurrence and statutory workers compensation insurance.

Section 4:   The registration fee for all general contractors and sub-contractors shall be $25.00 and may be renewed annually for the renewal fee of $25.00.

Section 5: Once qualified, all contractors and sub-contractors will remain on the approved list until removed therefrom by the Building Official due to non-payment  of registration fee, or revocation of the license or state certificate of responsibility or the performance bond expires or is revoked due to violations hereof.

Section 6: Nothing contained herein shall prohibit any individual from building his or her principal dwelling or from remodeling or expanding their existing dwelling. However, if subcontractors are used they must meet the requirements of this ordinance.

Section 7: This ordinance does not require that maintenance work be performed by licensed sub-contractors.

Section 8: All building permit applications shall be initiated by the owner or contractor, or their agent, and all sub-contractors to work on the job must sign an application prior to issuance thereof.

Section 9: Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) or imprisonment in the county jail for a period not exceeding ninety (90) days or both.  Each day a violation is committed or continues shall constitute a separate offense and shall be punished as such.

Section 10: This ordinance shall repeal that certain Ordinance dated November 2, 1992, appearing in Minute Book 107 at pages 28 thru 30.

Section 11: This ordinance shall be effective
